Terms of Service

These Terms of Service ("Terms") govern the use of the website and courier service ("Service") of Delivery.be, operated by Beslan Sebiev (eenmanszaak), trading as Delivery.be, Bredabaan 485, 2170 Merksem, Belgium, enterprise number (KBO/BCE) 0666.847.284, VAT number BE0666847284 ("we", "us"). By creating an account or placing an order, you accept these Terms.
1. The service
Delivery.be is a platform that connects customers who need something delivered with local couriers in the Antwerp region. Orders are placed through the website, paid in advance, and picked up and delivered by a courier.
2. Service area
We deliver in Antwerp and the districts of Merksem, Deurne, Borgerhout, Berchem, Wilrijk, Hoboken, Ekeren and Borsbeek, plus Schoten, Brasschaat, Kapellen, Mortsel, Edegem, Wijnegem, Wommelgem and Zwijndrecht. We cannot accept an order outside this area; the website shows this automatically based on the postcode entered.
3. Age and account
You must be at least 18 years old and able to enter into a binding contract. You are responsible for the confidentiality of your account credentials and for all activity under your account. The information you provide must be accurate and up to date.
4. What we don't carry
We deliver lawful goods up to a maximum weight of 30 kg per order. You may not request delivery of:
- illegal goods, weapons, drugs, or stolen property;
- hazardous, flammable, or harmful materials;
- live animals;
- cash, or items of exceptionally high value, unless agreed in advance;
- anything that violates applicable law.
You are responsible for the contents and legality of any item you ask us to deliver.
5. Pricing and payment
The price is shown before you confirm an order and is based on distance, item size, and delivery speed. Payment is taken in advance via our payment provider (Stripe), with Bancontact or card. Placing an order creates a binding request for the Service at the displayed price.
6. Delivery times and availability
Delivery times are an estimate and depend on courier availability, traffic, and location. When no courier is immediately available, you may be offered a later time slot. We do not state a fixed or guaranteed delivery time.
7. Cancellation and refunds
You can cancel an order from your account before a courier has picked up the item. If an already-paid order is cancelled, the amount is refunded to your original payment method. If we cannot fulfil an order (for example, no courier becomes available), it is cancelled and refunded automatically.
8. Your responsibilities
- Provide accurate pickup and drop-off addresses and contact details.
- Ensure someone is available to hand over or receive the item where needed.
- Package the item adequately for transport.
9. Liability
To the extent permitted by Belgian law, our liability for loss of or damage to an item is limited to the value of the item, up to a maximum of [AMOUNT TO BE FILLED IN] per order. We are not liable for indirect or consequential losses. Nothing in these Terms excludes liability that cannot be excluded under Belgian law.
10. Couriers
Couriers using the platform must meet our verification requirements and comply with applicable Belgian transport, insurance, and tax rules. Additional terms apply to couriers at sign-up.
11. Consumer right of withdrawal
If you are a consumer, you retain all mandatory rights under Belgian and EU consumer law. Because our Service is performed immediately at your express request, the standard 14-day right of withdrawal may no longer apply once the service has begun, to the extent permitted by law.
12. Complaints procedure
Have a complaint about an order or our Service? Contact us first at hello@delivery.be. We aim to handle every complaint personally and as quickly as possible.
13. Dispute resolution
If we cannot resolve a complaint together, as a consumer you can use the EU's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr. Disputes fall under the jurisdiction of the competent courts of Antwerp, without prejudice to mandatory consumer protections.
14. Changes
We may update the Service and these Terms. Material changes will be communicated, and the "Last updated" date will reflect the current version.
15. Governing law
These Terms are governed by Belgian law.
16. Language versions
These Terms are available in Dutch, French and English. In the event of a difference in interpretation between the language versions, the Dutch version prevails, as the language of the company's place of establishment.
